TERMS AND CONDITIONS OF HIRE

Definitions
1.1 Soie Dress Hire, we, our, or us means SOIE Dress Hire Australia (ABN 83 806 810 477) and its authorised representatives.
1.2 Client, Customer, Renter, you, or your means the person entering into a booking with Soie Dress Hire Australia, including the cardholder who completes payment for the booking.
1.3 Garment means any dress, clothing item, accessory, or related product supplied by Soie Dress Hire Australia for hire.
1.4 Hire Fee means the rental fee payable for a Garment, including GST but excluding any bond, shipping charges, late fees, damage fees, replacement fees, cleaning fees, or other applicable charges.
1.5 Hire Period means the period commencing on the collection date or delivery date and ending on the agreed return date.
2. Acceptance of Terms
2.1 You accept these Terms by:
(a) placing a booking;
(b) making payment;
(c) signing these Terms electronically or otherwise; or
(d) using our services.
2.2 These Terms form a legally binding agreement between you and Soie Dress Hire Australia.
2.3 Where multiple persons participate in a booking, each person is jointly and severally liable for all obligations under these Terms.
2.4 If you are under 18 years of age, you warrant that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
3. Security Deposit and Payment Authorisation
3.1 A refundable security Deposit is required for all hires and will be charged at checkout.
3.2 The Deposit amount is:
(a) $100 for Garments with a Hire Fee under $300; or
(b) $200 for Garments with a Hire Fee of $300 to $1000; or
(C) $500 for Garments with a Hire Fee of $1000 or more.
3.3 The Deposit will be refunded following return of the Garment, provided:
(a) the Garment is returned on time;
(b) the Garment complies with these Terms; and
(c) no additional charges are payable.
3.4 By placing a booking, the Client authorises Soie Dress Hire Australia to charge the payment method used for the booking for:
(a) late fees;
(b) damage fees;
(c) excessive cleaning fees;
(d) replacement costs;
(e) unpaid amounts; and
(f) any other amounts owing under these Terms.
3.5 If charges exceed the bond amount, the Client remains liable for the balance.
4. Delivery and Returns
4.1 Garments will be dispatched using Australia Post Express Post or another carrier selected by us.
4.2 Delivery dates are estimates only and are not guaranteed.
4.3 We are not liable for delays caused by postal providers, couriers, weather events, industrial action, or circumstances beyond our reasonable control.
4.4 Clients must not remove any Signature on Delivery requirement.
4.5 Where postal returns are approved, the Client must lodge the prepaid satchel at an Australia Post Office before 4:00 pm on the agreed return date and retain proof of lodgement.
4.6 Risk in the Garment remains with the Client until the Garment is physically returned and accepted by Soie Dress Hire Australia.
5. Hire Period and Late Returns
5.1 A late fee of $40 per day applies for each day a Garment remains overdue.
5.2 Late fees may continue to accrue until the Garment is returned and accepted by us.
5.3 If a Garment remains unreturned for 15 days after the agreed return date, we may deem the Garment lost and charge up to 200% of the Garment’s replacement retail value.
5.4 Replacement value may include:
(a) retail purchase price;
(b) shipping and import costs;
(c) repair costs;
(d) sourcing costs; and
(e) reasonable administrative expenses.
6. Cleaning and Alterations
6.1 Professional cleaning is included in the Hire Fee.
6.2 Clients must not:
(a) wash;
(b) dry clean;
(c) iron;
(d) steam;
(e) repair;
(f) alter;
(g) tailor;
(h) pin;
(i) cut; or
(j) otherwise modify a Garment unless authorised in writing.
6.3 Additional cleaning fees may apply where a Garment is returned excessively dirty or stained beyond normal wear and tear.
7. Ownership and Risk
7.1 All Garments remain the property of Soie Dress Hire Australia at all times.
7.2 Risk passes to the Client upon collection or delivery and remains with the Client until the Garment is returned and accepted by us.
8. Damage, Excessive Cleaning and Loss
8.1 Clients must immediately notify us of any damage, staining, loss, theft, or other issue affecting a Garment.
8.2 Normal wear and tear is accepted.
8.3 The Client is responsible for any damage beyond normal wear and tear, including but not limited to:
(a) permanent staining;
(b) fake tan transfer;
(c) makeup staining;
(d) burns;
(e) tears;
(f) broken zippers;
(g) missing embellishments;
(h) smoke odour;
(i) exposure to unsafe environments; and
(j) unauthorised alterations.
8.4 Garments must not be worn in a manner likely to cause unreasonable damage, including dragging outdoors, exposure to mud, excessive moisture, body oils, glitter products, candles, smoke, or unsafe surfaces.
8.5 Where a Garment is damaged beyond economical repair, lost, or stolen, the Client may be charged up to the replacement retail value of the Garment together with associated costs under clause 5.4.
9. Fit, Sizing and Product Disclaimer
9.1 We do not guarantee fit, sizing, colour tone, fabric appearance, length, or suitability for a particular body shape, event, or purpose.
9.2 Clients are responsible for reviewing sizing information before booking.
9.3 Minor wear, small imperfections, and signs of prior use may be present due to the nature of garment hire and do not constitute faults.
10. Changes, Exchanges and Cancellations
10.1 All bookings are final and non-refundable.
10.2 No refunds will be provided for:
(a) change of mind;
(b) incorrect sizing selection;
(c) failure to wear the Garment;
(d) event cancellation;
(e) dissatisfaction with fit or appearance; or
(f) delays outside our reasonable control.
10.3 At our discretion, booking credits may be issued where sufficient notice is provided.
10.4 Requests for changes or exchanges are subject to garment availability and are not guaranteed.
11. Client Responsibilities
11.1 The Client agrees to:
(a) treat all Garments with reasonable care;
(b) return the Garment on time;
(c) follow all care instructions provided;
(d) provide accurate booking and contact information; and
(e) comply with these Terms at all times.
11.2 The Client must not:
(a) sub-hire;
(b) lend;
(c) sell; or
(d) transfer possession of a Garment to another person without our written consent.
12. Cancellation by Soie Dress Hire Australia
12.1 We reserve the right to refuse or cancel a booking at our discretion, including where fraudulent, abusive, suspicious, or inappropriate conduct is suspected.
12.2 We may cancel a booking at any time before the commencement of the Hire Period.
12.3 If we cancel a booking, we will refund any Hire Fees paid.
12.4 Except where required by law, our liability is limited to the refund of amounts paid.
13. Recovery Costs and Default
13.1 The Client must pay all amounts owing under these Terms.
13.2 The Client is responsible for reasonable costs incurred in recovering unpaid amounts, including debt collection fees, administrative costs, and legal costs.
14. Intellectual Property
14.1 All intellectual property rights relating to our website, branding, content, photographs, logos, text, and materials remain our property or the property of our licensors.
15. Privacy
15.1 We collect, use, and store personal information in accordance with our Privacy Policy.
15.2 By using our services, you consent to the collection and use of your personal information as described in that policy.
16. Warranties and Disclaimers
16.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law that cannot legally be excluded.
16.2 Subject to clause 16.1, all other warranties are excluded to the maximum extent permitted by law.
17. Limitation of Liability
17.1 To the maximum extent permitted by law, our liability is limited to the amount paid by the Client for the relevant hire.
17.2 We are not liable for indirect, consequential, incidental, special, or economic loss.
17.3 We are not liable for losses arising from:
(a) event cancellation;
(b) incorrect sizing selection;
(c) postal or courier delays;
(d) third-party services; or
(e) circumstances beyond our reasonable control.
18. Force Majeure
18.1 We are not liable for delays or failures to perform obligations caused by events beyond our reasonable control, including natural disasters, pandemics, transport disruptions, industrial disputes, government action, or failures of postal or courier networks.
19. Governing Law
19.1 These Terms are governed by the laws of Victoria, Australia.
19.2 The parties submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.
